Your right of withdrawal and the model withdrawal form
Introduction
This notice informs you about your statutory right of withdrawal (called Rücktritt in the German original, with Widerruf used as an older synonym) when purchasing an AgenticCutter licence under the Austrian Fern- und Auswärtsgeschäfte-Gesetz (FAGG, the Austrian distance and off-premises contracts act implementing EU consumer law, BGBl. I Nr. 33/2014 as amended). AgenticCutter is digital content, an app download together with a licence key, delivered to you immediately after purchase by email. As described below, this affects your right of withdrawal. This notice supplements the Terms and Conditions.
Who this right of withdrawal applies to
The right of withdrawal under the FAGG applies exclusively to consumers. For businesses within the meaning of § 1(3) FAGG that purchase AgenticCutter in the course of their trade, business, or independent professional activity, there is no statutory right of withdrawal. If you are unsure whether you acted as a consumer or as a business when purchasing, we resolve this in your favour by treating you as a consumer and granting you the right of withdrawal described below.
Your right of withdrawal (14 days)
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day the contract was concluded. Because AgenticCutter is digital content, the period starts at the conclusion of the contract, not at delivery.
Exercising the right of withdrawal
To exercise your right of withdrawal, you must inform me (Bernhard Götzendorfer, Rittingergasse 15/11, 1210 Vienna, Austria, email: office@gotzendorfer.at) by an unambiguous statement, for example by email, of your decision to withdraw from this contract. You may use the model withdrawal form below, though it is not mandatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, you will receive all payments received from you back without undue delay and no later than 14 days from the day on which I am informed of your decision to withdraw from this contract. For this reimbursement, I will use the same means of payment you used for the original transaction, unless expressly agreed otherwise with you. In no event will you be charged any fees as a result of such reimbursement.
Compensation for value where delivery already began
If you requested that delivery of the digital content begin during the withdrawal period, and you then exercise your right of withdrawal even though it has not yet expired, you must pay me a reasonable amount. This amount corresponds to the proportion of the content already delivered, up to the point in time at which you inform me of the exercise of the right of withdrawal, compared with the full scope of the contractually agreed content. In practice this case rarely arises for AgenticCutter: for a one-time purchase, the right of withdrawal generally already expires once full delivery begins, see the next section, so no partial compensation situation follows.
Expiry of the right of withdrawal for digital content
Under § 18(1) no. 11 FAGG, the right of withdrawal expires for contracts on the supply of digital content not supplied on a tangible medium once three conditions are jointly met:
- You have expressly consented to delivery of the digital content beginning before the withdrawal period expires.
- You have acknowledged and confirmed that you thereby lose your right of withdrawal.
- I have provided you with a confirmation of this agreement on a durable medium under § 7(3) FAGG.
For a one-time purchase, EUR 99, limited to the first 100 buyers, the full purchase price for a perpetual licence becomes due on payment, and the download plus licence key are delivered to you immediately in full. Where the three conditions above are met, your right of withdrawal therefore expires in full once this delivery begins.
For a subscription, EUR 7.99 per month or EUR 49 per year, the situation differs because the contract is designed as a recurring supply over time: only access to the current billing period is delivered immediately, and future billing periods have not yet been supplied at the time the contract is concluded. Where the three conditions above are met, your right of withdrawal therefore expires, with delivery beginning, only for the already-delivered, current billing period. Your right to cancel the subscription itself at any time, effective at the end of the current period, is unaffected and is governed by the Terms and Conditions.
How your consent is captured at checkout
Directly above the payment button on the Stripe checkout page, one of the following two notices is shown for every AgenticCutter plan. The Stripe checkout for AgenticCutter runs in German only today, so the notice actually shown to you is the German original quoted below; the English text next to it is a translation for your reference, not the wording that appears on the page.
For a one-time purchase, the notice reads, in the German original: „Download und Lizenzschlüssel erhalten Sie sofort nach der Zahlung per E-Mail, noch vor Ablauf der vierzehntägigen Rücktrittsfrist. Mit dem Kauf stimmen Sie dieser sofortigen Bereitstellung ausdrücklich zu und bestätigen, dass Ihr gesetzliches Rücktrittsrecht damit erlischt (§ 18 Abs. 1 Z 11 FAGG). Die freiwillige 30-Tage-Geld-zurück-Zusage bleibt davon unberührt. Details unter agentic-cutter.com/widerruf und agentic-cutter.com/agb.“ In English: "You will receive your download and licence key by email immediately after payment, before the 14-day withdrawal period expires. For a subscription, the notice reads, in the German original: „Der Zugang zu AgenticCutter wird Ihnen sofort nach der Zahlung per E-Mail bereitgestellt, noch vor Ablauf der vierzehntägigen Rücktrittsfrist. Mit dem Kauf stimmen Sie dieser sofortigen Bereitstellung ausdrücklich zu und bestätigen, dass Ihr gesetzliches Rücktrittsrecht damit für die bereits bereitgestellte, laufende Abrechnungsperiode erlischt (§ 18 Abs. 1 Z 11 FAGG). Die freiwillige 30-Tage-Geld-zurück-Zusage bleibt davon unberührt. By clicking the payment button, you complete the purchase and thereby confirm the immediate delivery and the resulting loss of the right of withdrawal described above. As evidence, a dated identifier is additionally recorded in the checkout session metadata that uniquely identifies the version of the notice shown; the corresponding wording itself is fixed in the source code and pinned by an automated test, in both languages. A separate, additionally clickable confirmation checkbox is not currently wired in; this notice itself serves as the confirmation, permanently available at agentic-cutter.com/widerruf.
Relationship to the voluntary 30-day money-back commitment
Independent of the statutory right of withdrawal and its possible expiry, I offer you a voluntary money-back commitment: within 30 days of purchase, you may request a full refund without giving a reason, by contacting me informally by email. This commitment applies regardless of whether your statutory right of withdrawal has already expired, and it does not restrict your statutory rights in any way.
Withdrawal button under § 13a FAGG
Since 19 June 2026, online traders in the EU have been required, wherever a right of withdrawal actually exists, to provide an easily accessible withdrawal button. Because the right of withdrawal for AgenticCutter, given the three conditions above, already expires for most purchases once immediate delivery begins, there is no right of withdrawal left in those cases for a button to trigger, and no such button is currently wired in. As long as your right of withdrawal exists, or you are unsure whether it has expired, exercise it informally by emailing office@gotzendorfer.at, at any time and without any prescribed form.
